Welcome to the Bagno Hotel website. By entering our website, you agree to these terms and conditions (the "Terms"). Bagno Hotel is an online service of Sanipex Group LLC (The Sanipex Group "We/our/us") provided for your personal use only, for the purpose of sale of clothing, accessories and other Items ("Items").

We have taken great care and placed a lot of effort to ensure that the Items on our website look exactly as they do in real life. However, color clarity will depend upon your own monitor and Sanipex therefore cannot guarantee that the color of the item purchased is absolutely accurate. Please read through these Terms before placing your order on our website. By using this site you agree to comply with these Terms.

In order to be able to make purchases through the Bagno Hotel website, you will be requested to register and provide your personal details. We will ask for your real name, contact phone number, e-mail address and other requested information as indicated. Moreover, when placing an order, you will be required to provide payment details and be able to prove that the payment details you have submitted are both valid and correct and you state, that you are the person referred to in the billing information provided.

The website is available only to individuals who meet the Sanipex terms of eligibility, who have been issued a valid credit card and who have authorized Sanipex to process a charge or charges on their credit card in the amount of the total purchase price for the item or items. We reserve the right to restrict multiple quantities of a specific item being shipped to any one customer or postal address.

By making an offer to purchase merchandise, you  authorize Sanipex to perform credit checks and to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your credit-card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate your credit card, to obtain an initial credit card authorization and to allow individual purchase transactions.

You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorized to use.

We may modify these Terms at our sole discretion. If you do not agree to the changes to these Terms, you need to stop using this website. By using this website after any such change(s), you agree to comply with the Terms as changed. Any changes made after you have placed an order with us, will not affect that order, unless we are required to make the change by law.

Making a purchase

When you make a purchase through the Bagno Hotel website, you are offering to buy it for the price stated, subject to these Terms. All orders are subject to acceptance and availability.

Placing an Order

We will guide you through the process of placing an order by a set of instructions on the Website. You place your order for any selected items by clicking on the [Confirm Order] button at the end of the on-line order process. Once you have placed your order, we will send you an email acknowledging the exact details of your order, providing you with a payment reference and the value of your order that will be debited from your credit card. Please bear in mind, that this is not an order confirmation or order acceptance from Sanipex.

Unless we have notified you, that we do not accept your order, or you have cancelled your order in accordance with the Returns policy, our acceptance of your order and the completion of the contract between you and us will take place when you receive an email from us notifying you, that we have despatched the Items ordered by you.

Our acceptance of your order will be deemed complete and received by you at the time and date of sending off the email. The deemed time and date of receipt by you shall apply regardless of technical problems you may experience with your PC, for reasons outside our control, you have not received that email.

We may not accept your order if:

• an item you have ordered is out of stock.
• we are unable to obtain authorization for your payment.
• we identify a product or pricing error.

We reserve the right to reject any offer to purchase by you at any time and at our sole discretion. We will try to keep our Website as up to date as possible, but cannot guarantee that any particular Item will always be available. If we can't supply any Item, we will release the funds being held to your account immediately.
 

Pricing Policy

The Bagno Hotel website is priced in US Dollars.

We are offering our customers the Delivery Duty Unpaid (DDU) system, which means that you will only be charged for the items purchased and shipping cost. Import duty and tax cost will be invoiced to you directly by (TNT, depending on your shipping address/region) or an import broker appointed by you. We recommend that you contact your local customs authority to specify a cost price prior to purchase completion.

Product prices are set at the beginning of each Year, using existing currency exchange rates. These prices are subject to change if the applicable currency exchange rate changes before your order is accepted or the items are subject to markdowns at any time during the selling period.

Payment

Payment will be debited and cleared from your account upon despatch of your order by Sanipex. You confirm that the credit card that is being used is yours or that you have been specifically authorized by the owner of the credit card to use it. All credit card holders are subject to validation checks and authorization by the card issuer.

If the issuer of your payment card refuses to authorize payment to Sanipex, we will not be liable for any delay or non-delivery.

At Sanipex we take the essential precaution to make our Sites secure.

All credit card transactions on Bagno Hotel website are processed using a secure online payment gateway that encrypts your card details in a secure host environment.

Moreover, we will take all reasonable care, as it is in our power to do so, to keep the details of your order and payment secure. In the absence of negligence on our part we cannot be held liable for any loss you may suffer, if a third party procures unauthorized access to any data you provide when accessing or ordering from the website.

Returns/Exchanges

Customer satisfaction is always our top priority, and as such we handle each query on an individual basis to the best of our ability. While we hope that you are always delighted with your order, if you are not perfectly satisfied with your goods we will happily offer you a full refund or exchange within a 14 days’ time frame after receipt of your goods. Items must be unused and in the original packaging. Please contact your Sales Advisor for further details.

Passing of property and risk

We will retain the legal ownership of the Items, until full payment has been made by you and such payment has been received by us. Legal ownership of the Items will immediately revert to us, if we refund any such payment to you.

Risk on the Items will pass to you upon delivery and signing the papers.

Arbitration under this agreement shall be conducted under the rules then prevailing of the International Chamber of Commerce. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise. To the extent arbitration is not permitted by applicable law, any dispute relating in any way to your visit to the Website shall be submitted to an appropriate court or other judicial body in Dubai, and all applicable provisions of this section shall apply.

Time shall not be of the essence of these Terms as regards any of the times, dates and/or periods mentioned herein.
